Terms of Service

These Terms of Service ("Terms") apply to your use of www.brilliantminds.com.au (the "Site") and to all purchases from Brilliant Minds Australia Pty Ltd (ABN 61 634 299 791) ("Brilliant Minds", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

1. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law (ACL) or any other law that cannot be excluded. Our goods come with guarantees that cannot be excluded under the ACL.

2. Products and pricing

• All prices are in Australian dollars (AUD) and include GST unless stated otherwise. Delivery fees are shown at checkout.
• We try to make sure product descriptions, images and prices are accurate. Colours and designs may vary slightly from images, and manufacturers may change packaging without notice.
• If a product is listed at an incorrect price due to an error, we will contact you before processing the order and you can choose to proceed at the correct price or cancel for a full refund.
• We may limit quantities, change prices or discontinue products at any time. Price changes do not affect orders already confirmed.

3. Orders

Your order is an offer to buy. We accept your order when we dispatch it or confirm it by email. We may decline or cancel an order (for example, if an item is out of stock, a pricing error has occurred, or we suspect fraud). If we cancel, we will refund any amount you have paid in full.

4. Payment

Payment is due at the time of ordering unless you have an approved account with us. Payments are processed securely by our payment providers, and we do not store your full card details.

5. School and business accounts

Schools and businesses may apply for a 30-day account. Accounts are subject to approval. Invoices are payable within 30 days of the invoice date unless otherwise agreed in writing. We may suspend account ordering if invoices are overdue. Bulk and commercial orders may be quoted separately and are subject to volume pricing agreed with you.

6. Personalised and custom products

For personalised or custom-made items (such as printed or engraved products), you are responsible for checking that names, spelling and other details are correct before placing your order. Because these items are made especially for you, they cannot be returned for change of mind, but your rights for faulty items under the ACL still apply. You must have the right to use any names, logos or artwork you provide, and we may decline any personalisation request that we consider inappropriate or that may infringe someone else's rights.

7. Delivery and returns

Delivery is covered by our Shipping Policy, and returns are covered by our Returns & Refunds Policy.

8. Price Match Promise

If you find an identical item advertised for less by another Australian retailer, we will match that price. To qualify:

1. the item must be identical (same brand, model, size, colour and pack quantity) and new, not refurbished or second-hand;
2. the competitor must be an Australian retailer with the item in stock and available to buy at the time of your request;
3. we compare the total price including GST and delivery to the same address; and
4. you must show us the advertised price (a link, screenshot or catalogue) before you place your order. We can't adjust orders that have already been placed.

The Price Match Promise does not apply to clearance, liquidation, ex-display, refurbished or second-hand items; marketplace or auction sellers; member-only, loyalty, trade, tender or contract pricing; bundle deals, coupons, gift-with-purchase or cashback offers; gift cards; or pricing errors. It can't be combined with any other discount or promotion. We may limit quantities to normal household or organisation use, or decline a price match at our discretion. 9. Using our Site

You must not use the Site in a way that is unlawful, infringes anyone's rights, interferes with the Site or other users, introduces viruses or harmful code, or sends unsolicited messages. We may suspend or restrict access to the Site at any time.

10. Intellectual property

Unless otherwise stated, we own or license all content on the Site, including text, images, logos and designs. You must not copy, reproduce or use our content for commercial purposes without our written permission.

11. Reviews and user content

If you submit reviews, photos or other content, you grant us a non-exclusive, royalty-free licence to use it on the Site and in our marketing. You must not submit content that is false, misleading, offensive or that infringes anyone's rights. We may remove any content at our discretion.

12. Third-party links

The Site may contain links to other websites. We are not responsible for their content or practices.

13. Limitation of liability

Subject to your rights under the ACL, we are not liable for any indirect or consequential loss arising from your use of the Site or our products. Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited (at our option) to replacing or repairing the goods, or paying the cost of doing so.

14. Changes to these Terms

We may update these Terms from time to time by publishing the updated version on the Site. The Terms in force at the time you place an order apply to that order.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. If a dispute arises, please contact us first so we can try to resolve it informally.
